Agreement to Our Legal Terms

We are Hashery LLC ("Company", "we", "us", "our"), a New Jersey-licensed cannabis retailer registered at:

409 NJ-17, Hackensack, NJ 07601 · NJ-CRC license RE000185.

We operate hasherynj.com (the "Site"), the Hashery iOS and Android mobile applications (each, the "App"), and any related products and services that link to these legal terms (collectively, the "Services").

Hashery is a curated e-commerce platform offering cannabis products for adult use only (21+).

These Legal Terms constitute a legally binding agreement between you and Hashery. By accessing the Services, you agree to be bound by these Legal Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY.

We may update these terms at any time by changing the "Last updated" date. Continued use after updates constitutes acceptance.

The Services are intended for users who are at least 21 years old. Persons under 21 are not permitted to use, register for, or purchase from the Services. We verify age at checkout and at delivery.

Cannabis-Specific Disclosures (New Jersey)

Hashery is a Class 5 retailer licensed by the New Jersey Cannabis Regulatory Commission. By using this Site you acknowledge:

• Federal status: Cannabis remains a Schedule I substance under the federal Controlled Substances Act. We sell only in jurisdictions where adult-use cannabis is legal.
• Possession limits (NJ adult-use): 1 ounce of cannabis flower, 5 grams of concentrate, or 1,000 mg of THC in edibles per transaction.
• No interstate transport: It is illegal to take cannabis products purchased here across state lines.
• Do not operate vehicles or machinery while under the influence of cannabis. Driving while impaired by cannabis is illegal in New Jersey under N.J.S.A. 39:4-50.
• Pregnancy and breastfeeding: Cannabis use during pregnancy or while nursing may cause harm to the developing fetus or infant. Consult a licensed healthcare provider.
• Cannabis products have not been evaluated by the FDA. They are not intended to diagnose, treat, cure, or prevent any disease.

Industry-Specific Compliance

Hashery operates within the regulated cannabis industry and complies with all applicable federal, state, and local laws governing the sale and distribution of cannabis-related products. It is the responsibility of the user to ensure compliance with all applicable laws before accessing or purchasing products through our platform. Hashery disclaims liability for any user's violation of applicable laws.

The Hashery Mobile App

The Hashery iOS and Android applications are free to download from the Apple App Store and Google Play. Your use of an App is also subject to the applicable App Store end-user license agreement (the Apple "Standard EULA" or Google Play's terms), which supplements these Legal Terms. In the event of a direct conflict between these Legal Terms and the App Store EULA, these Legal Terms govern your relationship with Hashery.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your personal, non-commercial use. You agree not to: (a) reverse-engineer, decompile, or disassemble the App except to the extent permitted by law; (b) modify, adapt, translate, or create derivative works; (c) remove or alter any proprietary notices; (d) use the App to violate any applicable law; or (e) attempt to access non-public areas of the App or its supporting systems.

The App is available only to verified adults aged 21 or older located in New Jersey at the time of use. The App requests permission to access your device's approximate location at first launch solely to confirm you are within New Jersey, as required by NJ Cannabis Regulatory Commission rules and Apple App Store / Google Play policies. You may revoke this permission at any time through your device's system settings; doing so will limit your ability to view the menu inside the App but will not affect your ability to use hasherynj.com.

No payment is processed inside the App. When you choose to check out, the App opens our hosted Dutchie checkout in your device's external browser (Safari View Controller on iOS, Chrome Custom Tab on Android). Payment is either collected at the register in our Hackensack store (in-store pickup) or processed by Dutchie under its own PCI-compliant flow (delivery). The App itself never collects, transmits, or stores payment card information.

Your Hashery account and HASH CASH balance are shared between the website and the App — a single profile, a single balance, one source of truth.

You may delete your account at any time from within the App at Profile → Delete my account, or on the web at hasherynj.com/account/delete/. Deletion is permanent and processed within 30 days; see the Privacy Notice for what is retained for regulator-mandated record-keeping.

Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, software, designs, audio, video, text, photographs, graphics, trademarks, service marks, and logos. The Content and Marks are provided on an "AS IS" basis for your personal, non-commercial use only. You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any part of the Services for commercial purposes without prior written consent. Purchases and Payment

We accept the following forms of payment:

• Cash
• Debit card with PIN

Due to federal banking restrictions on cannabis, we do not accept credit cards.

You agree to provide current, complete, and accurate purchase information. Sales tax (NJ 6.625%) and the local Hackensack cannabis transfer tax (2%) are added where required. All prices are in US dollars.

We reserve the right to: correct pricing errors after payment; refuse any order; limit quantities per customer, household, or order; and block orders that appear to be from resellers.

Returns and Refunds

All cannabis sales are final under New Jersey law (N.J.A.C. 17:30-12.7). We can only accept returns of unopened, defective product within 24 hours of delivery, with proof of purchase. For non-cannabis accessories, please contact us at info@hasherynj.com.

Prohibited Activities

You may not use the Services for any purpose other than those we have authorized. As a user, you agree not to:

• Systematically retrieve data to create databases or directories without our written permission
• Trick, defraud, or mislead other users
• Circumvent or interfere with security features of the Services
• Use the Services to harass, abuse, or harm others
• Misuse support services or submit false reports
• Resell, distribute, or share cannabis products purchased through the Site
• Violate any applicable federal, state, or local laws or regulations
• Upload or transmit malicious or harmful content

SMS Communications

Transactional texts. By giving us your mobile number (at checkout, in your HASH CASH account, or to sign in by phone), you agree we may send transactional service texts to that number, including via automated systems: order and delivery status updates and one-time login codes. These texts are part of the Services. Reply STOP to opt out or HELP for help; message and data rates may apply and frequency varies.

Marketing texts. Promotional and HASH CASH loyalty texts, where offered, require your separate opt-in, are handled through our loyalty provider, and are not a condition of purchase. You can opt out at any time by replying STOP.

Carrier is not liable for delayed or undelivered messages.

Term and Termination

These Legal Terms remain in effect while you use the Services. We reserve the right—at our sole discretion and without notice—to deny access (including blocking IP addresses) for any reason, including breach of these Terms or applicable law.

Modifications and Interruptions

We reserve the right to modify, remove, or discontinue any part of the Services at any time without notice. We are not liable for any loss, damage, or inconvenience caused by such interruptions.

Governing Law

These Legal Terms are governed by and construed in accordance with the laws of the State of New Jersey, applicable to agreements made and performed entirely within New Jersey, without regard to conflict of law principles.

Dispute Resolution

Both parties agree to first attempt to resolve any issue informally for at least 30 days before initiating formal proceedings. If informal resolution fails, the dispute shall be resolved in a court of competent jurisdiction within the State of New Jersey, and both parties consent to the personal jurisdiction of that court.

Disclaimer

The Services are provided "as-is" and "as-available". By using the Services, you agree to do so at your own risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for personal injury, property damage, unauthorized access to personal data, or losses from using content, errors, or omissions.

Miscellaneous

These Legal Terms, along with any policies or rules posted on our Site, constitute the entire agreement between you and Hashery. Our failure to enforce any part of these terms does not waive our right to enforce it later. If any part of these terms is deemed unlawful or unenforceable, the rest remains valid.
